Lomarengas Oy and FinFun Oy
Lomarengas/FinFun applies the following terms and conditions to the ordering and booking of cottage holiday services as well as to the cancellation of booked services. These terms and conditions become binding to both parties once the client has paid the deposit mentioned in these contract terms to Lomarengas/FinFun or paid both the deposit and the final instalment together.
TERMS OF BOOKING AND PAYMENT
The customer will be sent an invoice, which will include the name and contact particulars of the owner or custodian of the cottage, driving directions to the location where the key will be handed over or to the cottage as well as the bank account number of Lomarengas/FinFun. Any objections to the invoice must be made within 7 days of the invoice date. The customer ID number and the number of the invoice must be mentioned in the payment.
The booking is confirmed once the customer has paid the deposit (20% of the cottage rent, but no more than €148) by the due date (14 days from the invoice date) or once the customer has paid both the deposit and the final instalment together. The final instalment must be paid no later than six (6) weeks prior to the start of the holiday.
If a cottage is booked for four weeks or more or if the rent exceeds €2,500, 50% of the rent will be charged as a deposit; the deposit may not exceed €500, however.
If the client fails to pay or misses the payment deadline, the booking may be cancelled without further notification.
If the booking is made 63 days (9 weeks) or more before the start of the rental period, the rent will be paid in two instalments. The deposit must be paid within 14 days of the invoice date and the remaining amount 6 weeks before the holiday is due to start.
If the booking is made 50-62 days (7-9 weeks) before the start of the rental period, the sum must be paid in full 6 weeks before the holiday is due to start.
If the booking is made 21-49 days (3-7 weeks) before the start of the rental period, the sum must be paid in full within one week of the invoice date.
If the booking is made 20 days or less before the start of the rental period, the sum must be paid in full and within 2 days of the invoice date.
If the booking is made 6 days or less before the start of the rental period, the full sum must be paid immediately on booking.
No reminders will be sent for bookings due to begin in 20 days or less. Should the client fail to pay, Lomarengas/FinFun will cancel the client’s booking without further notification.
TERMS OF BOOKING/PAYMENT IN THE PERIOD 27 DEC 2010 – 10 JAN 2011
A mandatory increased cleaning fee (€250 at maximum) will be added to the rent in the case of all bookings. A mandatory fee for bedclothes will be added to the rent. The deposit is 300 – 500 €. The final instalment must be paid no later than ten (10) weeks prior to the start of the holiday.
Lomarengas/FinFun observes special terms and conditions to the booking and payment of holiday cabins and apartments when the reservation is placed by a travel agency/holiday organizer. The travel agency/holiday organizer will be notified about these terms before the final confirmation of the reservation by Lomarengas/FinFun.
CANCELLATION OR CHANGE OF BOOKING
Any cancellations must be made to Lomarengas/FinFun in writing (by letter, e-mail or fax). The date on which Lomarengas/FinFun receives the notification will be regarded as the date of cancellation. Should the client be able to prove that the cancellation was made and sent to the right address at the right time, a cancellation may be accepted despite late arrival or failure to arrive.
In the case of a cancellation, the client will forfeit the deposit. If the cancellation is made less than 21 days before the start of the stay, the client will be charged the entire sum for the accommodation. If the accommodation can be rented to another client from whom the equivalent sum is obtained, the deposit will be retained as a cancellation fee.
Regardless of the above, all sums with the exception of the deposit paid to Lomarengas/FinFun will be refunded if the client or a person from the same household falls seriously ill, has an accident or dies. In this case, Lomarengas/FinFun must be informed immediately of the cancellation, which must be properly verified by, for example, a doctor’s certificate. If the cancellation is made less than 48 hours from the start of or during the holiday, payments already made by the client will not be refunded.
Lomarengas/FinFun will charge €20 for any changes to bookings (destination, dates, extra services or number of persons). All changes must be made at least six (6) weeks before the start of the stay. Any changes made after this date will be treated as a cancellation of the previous booking and a subsequent new booking.
RIGHT OF LOMARENGAS/FINFUN TO CANCEL A BOOKING
Lomarengas/FinFun may cancel a booking in the event of force majeure. In this case, the client is entitled to a full refund of the sum paid to Lomarengas/FinFun. If the customer fails to pay or misses the payment deadline, the booking may be cancelled without further notification. If a booking has to be interrupted because of disruptive behaviour on the part of the client, no payments will be refunded.
STAY AT COTTAGE
The keys to the cottage will be handed over to the client at the time of arrival as estimated and notified to the cottage owner or custodian by phone or in writing. The owner or custodian is entitled to charge a deposit of €75 against the loss of the keys. If the client fails to return the keys and their loss can be attributed to the client’s negligence, the actual cost of replacing the cottage’s locks less any deposit will be charged.
In the case of a one-week stay, a cottage will be at the client’s disposal from 16.00 (4 pm) on the day of arrival to 12.00 (12 noon) on the day of departure. In the case of a weekend stay, the cottage will be at the client’s disposal from Friday afternoon at 16.00 (4 pm) to Sunday evening at 22.00 (10 pm). At ski resorts in the case of a weekend stay, the cottage will be at the client’s disposal from Friday afternoon at 16.00 (4 pm) to 12.00 (12 noon) on Sunday. The cottage-specific checkout time is mentioned in the invoice or the destination description.
The weekly rent for detached cottages covers the use of the accommodation and sauna. Free use of a rowing boat is only included in summertime rentals of shore cabins if this is explicitly mentioned in the contract. A separate charge may be made for the use of a sauna and rowing boat in holiday cottage villages or resorts.
The cottage rent covers the furnishings, cooking and eating utensils, and fuel for heating, cooking and lighting. Mattresses, bed covers and pillows are included in the rent. Sheets and towels are not included in the rent.
The client is responsible for cleaning the cottage during the rental period and on departure. The owner or custodian of the cottage is entitled to charge a €75 deposit for cleaning. Should the client fail to tidy the cottage appropriately on departure and the owner/custodian be obliged to clean it before the next client arrives, the owner, custodian or Lomarengas/FinFun will be entitled to charge the client a supplementary fee of at least €75 less any deposit for the cleaning work.
The number of people using the cottage must not exceed the number of sleeping places stated in the description or the number agreed on during booking. Tents and caravans are not permitted on a holiday cottage plot without the owner’s permission. Pet-owners must notify their intent to bring animals to the destination when booking; pets may only be brought to destinations which explicitly allow this. Smoking is not allowed indoors.
COMPENSATION FOR DAMAGE AND FORCE MAJEURE
The client will be required to pay the owner direct for any damage caused to the cottage or its contents during occupancy.
Lomarengas/FinFun will not be liable for any damage or inconvenience incurred by the client in the event of an unpredictable and insurmountable obstacle (force majeure) or some other comparable reason, such as a natural phenomenon, power failure, etc., that was not caused by Lomarengas/FinFun and that Lomarengas/FinFun could not with all due reason foresee. Neither is Lomarengas/FinFun responsible for any damage or inconvenience caused by regular natural phenomena.
COMPLAINTS
Any objections and complaints regarding the holiday accommodation must be made immediately once the cause for them arises and addressed to the owner or custodian of the property direct. If the matter is not satisfactorily attended to, the client should contact Lomarengas/FinFun within 72 hours. Should the matter still not be satisfactorily attended to, the client may make a written complaint to Lomarengas/FinFun. Normally, this should be done within one month of the end of the rental period.
APPLICABLE LAW AND VENUE FOR THE RESOLUTION OF DISPUTES
The contracting parties will attempt to resolve any disputes out of court. Should they fail to reach agreement, any disputes will be settled by the Helsinki District Court. The contract is governed solely by Finnish law.
RIGHT TO CHANGE PRICES
Lomarengas/FinFun reserves the right to correct any errors in the price list before a rental agreement is made. Once an agreement has been made, Lomarengas/FinFun has the right to raise and a corresponding obligation to reduce the agreed price in the event of any changes in the taxes or public charges affecting the price of the holiday service.
